is the process of ending a marriage or conjugal union. Divorce usually involves the cancellation of a marriage contract between a man and a woman, dissolving the marital relationship and the legal responsibilities that come with it.<\/p>\n\n\n\n<p>Divorce can result in issues such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Child custody<\/li>\n\n\n\n<li>Alimony and child support<\/li>\n\n\n\n<li>Family residence<\/li>\n\n\n\n<li>Family patrimony<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_procedures_of_a_divorce\"><\/span>What are the procedures of a divorce?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mediation\"><\/span>Mediation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The mediation procedure was introduced by the law of June 13, 1997 in the National Assembly of Quebec. Mediation procedures are preferred in Quebec in order to avoid a trial. The question of reconciliation is an issue that arises when a divorce proceeding is initiated.<\/p>\n\n\n\n<p>A professional counsellor or member of the bar may be called upon to intervene in a divorce as a mediator. This procedure can be assisted by the state.<\/p>\n\n\n\n<p><em>Note that a government program has been stipulated to allow couples to pay the fees.<\/em><\/p>\n\n\n\n<p>An information meeting can be organized by the government to give all the elements during a divorce and accompany the couple during this painful stage.<\/p>\n\n\n\n<p>There is also a free information session on co-parenting for parents in a situation of rupture to give all the elements concerning a divorce procedure. It can take two forms:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sole_custody\"><\/span>Sole custody<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Sole custody involves giving the legal responsibility to care for the child and make all decisions about the child. The children live with this parent most of the time.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Shared_custody\"><\/span>Shared custody<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Both parents share the rights and responsibilities of their children. This means:<\/p>\n\n\n\n<p>The children may live with both parents or only one parent,<br>Both parents make a decision about the children.<\/p>\n\n\n\n<p>This sharing is not necessarily in the form of a 50\/50 split but may be 40\/60 depending on the case.<\/p>\n\n\n\n<p>In the event that the parents disagree, the child will decide and make the decision between one of the two parties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_criteria_for_child_custody\"><\/span>What are the criteria for child custody?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Here are the criteria for a child custody:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Age of the child,<\/li>\n\n\n\n<li>The child&#8217;s needs,<\/li>\n\n\n\n<li>Ability of each parent to meet those needs,<\/li>\n\n\n\n<li>Relationship between the child and each parent,<\/li>\n\n\n\n<li>Relationship between the child and the family members,<\/li>\n\n\n\n<li>Stability of the child,<\/li>\n\n\n\n<li>Physical and mental health,<\/li>\n<\/ul>\n\n\n\n<p>It should be noted that both parents retain their <a href=\"https:\/\/avocat-montreal.ca\/en\/family-law\/understanding-parental-authority-in-legal-matters\/\">parental authority<\/a> over the child regardless of the court decision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_about_child_support\"><\/span>What about child support?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>It is to be noted that the parental authority, and those whatever the procedure, keeps the right of authority as father and mother concerning the child of which they have in their charge.<\/p>\n\n\n\n<p>Element in Depending on your family situation and the options you choose, you would have to pay between $500 and $1,800.<\/p>\n\n\n\n<p>In the case of a couple without children, this may be relevant because the procedure is inexpensive and quick.<\/p>\n\n\n\n<p>Please note that the parties are not obliged to hire a lawyer.
