Represented herein by <i>[name of representative]<\/i>, acting in the capacity of <i>[function]<\/i>.<\/p>\n<p>Hereinafter referred to as <strong>the &#8220;Employer&#8221;.<\/strong><\/p>\n<p><strong>And<\/strong><\/p>\n<p><strong>Employee:<\/strong> <i>[Employee&#8217;s full name]<\/i>, residing at <i>[full address]<\/i>, holder of Social Insurance Number <i>[SIN]<\/i>.<\/p>\n<p>Hereinafter referred to as <strong>&#8220;Employee&#8221;.<\/strong><\/p>\n<p><strong>Preamble:<\/strong> This contract is a <strong>fixed-term contract (CDD)<\/strong> entered into pursuant to the provisions of the Civil Code of Qu\u00e9bec and the <i>Act respecting labour standards,<\/i> in particular<strong>article 2085 C.c.Q.<\/strong>, to ensure the temporary replacement of an absent employee.<\/p>\n<p>The parties agree as follows:<\/p>\n<h2><span class=\"ez-toc-section\" id=\"General_provisions_of_the_fixed-term_contract\"><\/span>General provisions of the fixed-term contract<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Purpose_of_the_contract\"><\/span><strong>Purpose of the contract<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The present contract is concluded for the purpose of <strong>temporarily replacing an absent employee<\/strong>, namely <i>[name of replaced employee]<\/i>, whose absence is due to <i>[reason for absence: maternity leave, illness, parental leave, etc.]<\/i>. It is understood that the return of the replaced employee will automatically terminate this contract, without any formality of termination being required, in accordance with the provisions of<strong>section 82.1 of the Act respecting labour standards<\/strong>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Position_held\"><\/span><strong>Position held<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Employee will perform the duties of <i>[job title]<\/i>, which include but are not limited to the following tasks: <i>[detailed description of duties, responsibilities and objectives related to the position]<\/i>. The Employee undertakes to perform these duties diligently, competently and faithfully, in accordance with the Employer&#8217;s quality standards.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Place_of_work\"><\/span><strong>Place of work<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The principal place of performance of the duties shall be established at <i>[address of place of work]<\/i>. However, the Employee agrees that this location may be changed within a reasonable radius to meet the Employer&#8217;s organizational needs, in accordance with<strong>article 2091 C.c.Q.<\/strong>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Term_of_Contract\"><\/span><strong>Term of Contract<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This contract is effective as of <i>[start date]<\/i> and will terminate upon the return of the absent employee or no later than <i>[maximum end date]<\/i>. In no case may the fixed term exceed the period of absence of the replaced employee. Any extension must be the subject of a <strong>written amendment signed by both parties<\/strong>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Working_hours\"><\/span><strong>Working hours<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Employee&#8217;s work schedule is set at <i>[number of hours]<\/i> hours per week, distributed as follows: <i>[working days and hours]<\/i>. Any significant change to the schedule will be subject to prior agreement between the parties.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Remuneration\"><\/span><strong>Remuneration<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Employee shall receive a gross remuneration of <i>[amount]<\/i> per <i>[hour\/week\/month]<\/i>, payable according to the Employer&#8217;s usual payroll frequency. Such compensation is subject to applicable statutory deductions. It may include or exclude vacation pay, as specified in the following clause.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Vacation_and_Holidays\"><\/span><strong>Vacation and Holidays<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>In accordance with the <i>Act respecting labour standards<\/i>, Employees are entitled to vacation pay equivalent to <strong>4% or 6% of gross salary<\/strong>, depending on their experience, as well as statutory holidays, unless they occur while the Employee is not on the job.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Employee_benefits\"><\/span><strong>Employee benefits<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>To the extent applicable, the Employee will be entitled to the benefits offered by the Employer to employees of equivalent status. The precise terms of these benefits will be described in a separate document appended to this contract or given to the Employee upon hiring.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Employees_obligations\"><\/span><strong>Employee&#8217;s obligations<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Employee undertakes to comply with all internal policies, regulations, codes of ethics and operational instructions in force within the Company. Any serious breach of these policies may result in <strong>early termination of the contract for cause<\/strong>, in accordance with<strong>article 2094 C.c.Q.<\/strong><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Confidentiality_clause\"><\/span><strong>Confidentiality clause<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Throughout his employment and after termination of the present contract, the Employee undertakes to keep strictly confidential all sensitive or strategic information relating to the Employer, its customers, partners or employees, on pain of civil proceedings.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Termination_final_provisions_and_legal_notice\"><\/span>Termination, final provisions and legal notice<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Termination_of_contract\"><\/span><strong>Termination of contract<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The present <strong>fixed-term contract<\/strong> terminates automatically on the return of the replaced employee or on the maximum date specified in article 2. Any early termination must comply with the following conditions:<\/p>\n<ul>\n<li><strong>Termination by the Employer<\/strong>: the Employer may terminate the contract before its term only for <strong>serious cause<\/strong>, as provided for in<strong>article 2094 of the Civil Code of Qu\u00e9bec<\/strong>.
