id=\"Preamble\"><\/span>Preamble<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>WHEREAS the Employee is bound to the Employer by a contract of employment entered into on <i>[date of initial N-1.1)<\/strong>;<\/p>\n<p>THEREFORE, the Parties agree as follows:<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Section_2_Changes_to_the_employment_contract\"><\/span>Section 2: Changes to the employment contract<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"21_Purpose_of_the_amendment\"><\/span><strong>2.1 Purpose of the amendment<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The <strong>purpose<\/strong> of this amendment is to modify certain conditions of the initial employment contract signed between the Parties, in order to incorporate a specific clause relating to<strong>theperformance of teleworking duties<\/strong>. The purpose of this mode of organization is to enable the Employee to perform his or her duties remotely, within a defined and supervised framework that complies with the legal requirements in force in Quebec.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"22_Telework_location\"><\/span><strong>2.2 Telework location<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>It is agreed that the Employee will perform his or her duties from his or her <strong>principal place of residence<\/strong>, located at the following address: <i>[full address]<\/i>. Any change of teleworking location must be <strong>requested in writing<\/strong> and <strong>approved<\/strong> in <strong>advance<\/strong> by the Employer. This location must be suitable for the performance of duties, safe, quiet, and allow <strong>confidentiality obligations<\/strong> to be respected.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"23_Terms_and_frequency_of_teleworking\"><\/span><strong>2.3 Terms and frequency of teleworking<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Parties agree that telework will be carried out on a <strong>regular basis<\/strong> agreed in advance, i.e. <i>[number of days]<\/i> days per week, including <i>[indicate days]<\/i>, during <strong>regular working hours<\/strong>. The Employee remains obliged to respect the <strong>agreed schedule<\/strong> and to comply with any instruction or summons from the Employer requiring his\/her presence at the physical work site.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"24_Supply_of_materials_and_tools\"><\/span><strong>2.4 Supply of materials and tools<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Employer undertakes to provide the Employee with the <strong>equipment necessary<\/strong> to perform his or her duties remotely, including in particular a <strong>secure laptop computer<\/strong>, access to a <strong>virtual private network (VPN)<\/strong> and, where applicable, communication tools such as a <strong>business telephone<\/strong> or <strong>videoconferencing application<\/strong>. The Employee undertakes to use this equipment exclusively for professional purposes, to maintain it in good condition and to ensure its <strong>physical and digital security<\/strong>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"25_Reimbursement_of_teleworking_expenses\"><\/span><strong>2.5 Reimbursement of teleworking expenses<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Parties recognize that teleworking may give rise to certain <strong>additional costs<\/strong>. In this respect, the Employer undertakes to cover, on presentation of supporting documents, part of the following costs: <strong>Internet connection<\/strong>, <strong>electricity consumption<\/strong> linked to professional use, and any other <strong>costs directly attributable<\/strong> to the activity carried out remotely, within the limits of internal reimbursement policies. Reimbursement terms and conditions will be specified in a separate document given to the employee.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"26_Confidentiality_and_data_protection\"><\/span><strong>2.6 Confidentiality and data protection<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Employee acknowledges that he\/she is bound by the <strong>confidentiality obligations<\/strong> arising from his\/her initial employment contract. He\/she shall take all reasonable steps to <strong>preserve the confidentiality of data<\/strong>, documents and exchanges carried out in the course of his\/her duties. The use of a secure Wi-Fi network, the locking of screens in case of absence, and the non-disclosure of sensitive information to third parties are considered essential. Any <strong>breach of<\/strong> this obligation may result in disciplinary action or even termination of contract.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"27_Accessibility_availability_and_supervision\"><\/span><strong>2.7 Accessibility, availability and supervision<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>During periods of teleworking, the Employee remains <strong>fully available<\/strong> and reachable via the usual channels of communication: <strong>professional e-mail<\/strong>, <strong>telephone<\/strong>, and <strong>videoconferencing<\/strong>. The Employer may, at any time during working hours, organize follow-up meetings or request an activity report. The Employee undertakes to respond within a reasonable time and to be <strong>transparent about the progress of his\/her tasks<\/strong>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"28_Reversibility_of_teleworking\"><\/span><strong>2.8 Reversibility of teleworking<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Employer reserves the right, at its discretion, to <strong>terminate telecommuting<\/strong> or modify its terms and conditions, subject to <strong>10 working days&#8217; written notice<\/strong>. This decision may be motivated by <strong>organizational imperatives<\/strong>, a change of position, a breach of contractual obligations or any other reason deemed valid by the Employer.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Section_3_Final_provisions\"><\/span>Section 3: Final provisions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"31_Entire_agreement\"><\/span><strong>3.1 Entire agreement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This agreement constitutes<strong>theentire agreement between the Parties<\/strong> with respect to the terms and conditions of telecommuting. It replaces any previous communication, promise or agreement &#8211; whether verbal or written &#8211; on this subject. No modification shall be valid unless <strong>made in writing and signed by<\/strong> both Parties.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"32_Effective_Date\"><\/span><strong>3.2 Effective Date<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Telework as defined herein shall take effect as of <i>[effective date]<\/i>. It shall remain in force for a period of <i>[fixed\/indefinite]<\/i>, unless terminated in advance in accordance with the terms of point 2.8.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"33_Continuation_of_other_contractual_provisions\"><\/span><strong>3.3 Continuation of other contractual provisions<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Parties agree that <strong>all other clauses of the initial employment contract<\/strong> remain unchanged and fully applicable. The purpose of this model agreement is to <strong>provide concrete tools for employers and employees<\/strong> wishing to formalize this transition legally, within a clear and balanced framework.<\/p>\n<p>As a reminder :<\/p>\n<ul>\n<li><strong>The telecommuting location<\/strong> must be precisely designated and validated by the employer.<\/li>\n<li><strong>Schedules<\/strong> must comply with the initial contract, unless mutually agreed otherwise.<\/li>\n<li><strong>Confidentiality obligations<\/strong> must be rigorously respected when teleworking.<\/li>\n<li><strong>Business expenses<\/strong> may be partially reimbursed by agreement.<\/li>\n<li>The employer has the<strong>rightto revoke<\/strong> the telecommuting arrangement, subject to certain conditions.<\/li>\n<\/ul>\n<p>Please note that according to the <strong>Quebec Act respecting labour standards<\/strong><i>(RLRQ c N-1.1<\/i>), telecommuting does not affect the employee&#8217;s fundamental rights, particularly with regard to :<\/p>\n<ul>\n<li><strong>working hours<\/strong> (sections 52 to 59),<\/li>\n<li><strong>breaks and rest<\/strong> (article 79.1),<\/li>\n<li><strong>safety equipment<\/strong>,<\/li>\n<li><strong>respect for privacy<\/strong> (Charter of Human Rights and Freedoms, <i>article 5<\/i>).<\/li>\n<\/ul>\n<p>The <strong>Canada Labour Code<\/strong> also imposes <strong>obligations<\/strong> on employers <strong>to prevent psychosocial risks<\/strong> and maintain mental health, even at a distance.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Practical_advice\"><\/span><strong>Practical advice<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><i>Consider attaching a &#8220;Guide to good teleworking practices&#8221; to the rider, specifying, for example :<\/i><\/p>\n<ul>\n<li><i>rules for using communication software,<\/i><\/li>\n<li><i>procedures in the event of breakdown or isolation,<\/i><\/li>\n<li><i>instructions for protecting sensitive data at home.<\/i><\/li>\n<\/ul>\n<p><strong>In conclusion,<\/strong> setting up a telecommuting agreement is not a trivial formality.
