What is a formal notice (demand letter)?
A formal notice is a written demand by which a creditor asks the debtor to perform an obligation within a reasonable time limit. In Quebec, it is governed by articles 1594 to 1600 of the Civil Code of Québec. It must be in writing and give the debtor sufficient time to perform, taking into account the nature of the obligation (art. 1595 C.C.Q.).
Why send one?
- it is generally required before suing, failing which you may have to bear the legal costs;
- it puts the debtor in default and starts the running of interest;
- it often settles the dispute without going to court.
How to send it
Use a method that provides proof of delivery: registered mail, service by bailiff or email with acknowledgment of receipt. Keep a copy of the letter and the proof of sending.
And then?
If the debtor does not comply, you can file a claim with the Small Claims Division of the Court of Québec (up to $15,000), the Tribunal administratif du logement for housing matters, or the competent court. For complex cases, consult a lawyer.
