Option B – Resiliation on a statutory ground: Please be advised that I am resiliating my lease because of [my permanent admission to a CHSLD, a private seniors’ residence or another residential facility / the allocation of a low-rental dwelling / domestic violence or sexual aggression threatening my safety or that of a child / a disability preventing me from occupying the dwelling]. Please find attached [the required attestation]. The resiliation will take effect [two months / one month] after this notice is sent, namely on [date] [or earlier if the dwelling is re-leased].

Drafting notes
- Notice of non-renewal: lease of 12 months or more, 3 to 6 months before the end; lease of less than 12 months, 1 to 2 months before; lease of indeterminate term, 1 to 2 months before the intended departure.
- Outside the statutory grounds of resiliation (Civil Code of Québec), the tenant may not terminate early but may assign the lease or sublet; the landlord may refuse only for a serious reason.
- For domestic violence or sexual aggression, the notice must be accompanied by an attestation from a public officer designated by the Minister of Justice.
- Keep proof of sending: the burden of proving that notice was given on time lies with the tenant.
