Re: Demand letter – unpaid rent, dwelling located at [address]

Dear Sir or Madam,

Under the lease dated [date], your monthly rent of $[amount] is payable on the first day of each month. As of today, the rent for [month(s)] remains unpaid, for a total of $[amount].

I hereby formally demand that you pay this sum no later than [date]. I remain open to discussing a written payment arrangement.

Failing payment, I will apply to the Tribunal administratif du logement, without further notice, for recovery of the rent with interest and the additional indemnity and, the delay exceeding three weeks, for resiliation of the lease and your eviction.

Please govern yourself accordingly.

Drafting notes

  • Rent more than three weeks late allows the lessor to apply for resiliation (art. 1971 C.C.Q.); the tenant may avoid it by paying the rent, interest and costs before judgment (art. 1883 C.C.Q.).
  • Only the TAL may order eviction; the lessor may never change the locks or remove the tenant’s belongings.
  • Rent may be claimed with interest from the first day of default.
