Re: Notice of modification of the lease upon renewal – [address, apt. ___]
Dear Sir or Madam,
Your lease ends on [date]. I wish to renew it for [12 months], from [date] to [date], with the following modifications:
- new monthly rent: $[amount], i.e. an increase of $[amount] ([__]%);
- [other modification: e.g. parking now included at $___ / change of the term].
You have one month from receipt of this notice to inform me whether you accept the modifications, refuse them, or intend to leave the dwelling. If you do not reply within this time, you will be deemed to have accepted the renewal with the modifications.
If you refuse, the lease will be renewed and I may, within one month of receiving your refusal, apply to the Tribunal administratif du logement to have the rent fixed.
Sincerely,
[Signature]

Drafting notes
- Notice period for a 12-month lease: between 3 and 6 months before the end of the lease (art. 1942 C.C.Q.); 1 to 2 months for a lease of less than 12 months.
- The notice must state the new rent in dollars or the increase in dollars or percentage, and inform the tenant of their one-month time to refuse.
- The tenant’s refusal does not end the lease; the TAL fixes the rent using its regulatory calculation method.
