Drafting notes
- A holograph will must be entirely written by hand and signed by the testator (art. 726 C.C.Q.); a will made in the presence of witnesses requires two witnesses who sign in the testator’s presence (arts. 727 ff.).
- Holograph and witnessed wills must be probated after death (art. 772 C.C.Q.); a notarial will need not be.
- A legacy to a witness or to the spouse of a witness is null (art. 760 C.C.Q.); the family patrimony and survivor’s right to support apply regardless of the will.
