Failing this, I will institute legal proceedings against you without further notice or delay, [before the Small Claims Division of the Court of Québec / the competent court], to claim this sum with interest at the legal rate and the additional indemnity provided for in article 1619 of the Civil Code of Québec, together with costs.

Drafting notes
- The demand letter places the debtor in default (arts. 1594 and 1595 C.C.Q.); it must give the debtor a sufficient time to perform, having regard to the nature of the obligation.
- It is a prerequisite to most claims and determines the starting point of interest; send it by a means that provides proof of receipt.
- Stick to facts and avoid threats unrelated to legal remedies (e.g. criminal complaint as leverage), which may be characterized as extortion.
- Small Claims Division: claims up to ,000, without a lawyer.
