Re: Proposal for family mediation
[First name],
Since our separation on [date], we must make important decisions regarding [our children, [first names] / our residence / our property]. I would like us to make them together, respectfully, rather than leave a judge to decide for us.
I therefore propose that we meet with an accredited family mediator, a neutral person who will help us find solutions regarding:
- [parenting time and the organization of the children’s lives];
- [child support];
- [the partition of our property and debts];
- [other matter].
[If you have children: As parents, we are entitled to free mediation hours paid for by the Government of Québec.] I suggest [name of mediator, if any / that we choose a mediator together from the list of accredited mediators].
Could you reply by [date]? If you prefer, we can discuss it by phone.

Drafting notes
- The Government of Québec funds free mediation hours for separating couples with children (married or not), as well as hours to review an agreement or judgment.
- Before a contested family hearing, the parties must in principle attend an information session on parenting and mediation (Code of Civil Procedure).
- Mediation is not appropriate where there is domestic violence or a significant power imbalance; the mediator must screen for it.
- The mediated agreement should be reviewed by independent counsel and homologated by the court to become enforceable.
