Re: Formal notice – repayment of a loan

I am sending you this formal notice regarding the repayment of the loan granted to you by my client. Despite several verbal and written requests, you have still not made the repayment in accordance with the agreed terms. This letter therefore formalizes the express demand for repayment within the time limit set, failing which legal proceedings will be taken.

Statement of facts

On December 15, 2023, my client granted you a loan of CAD $10,000, to be repaid in full by June 15, 2024 under the agreement signed between you. However, as of today, June 27, 2024, you have not paid any amount, despite your contractual commitments.

This situation is causing my client serious financial harm. You must make full repayment, in accordance with the agreed conditions, in order to avoid any further complications.

Legal basis

Under articles 1375 and 1590 of the Civil Code of Québec (C.C.Q.), every borrower must repay the loan according to the agreed terms. Failure to meet this obligation engages your contractual liability and gives rise to remedies to obtain specific performance or compensation for the harm suffered.[1]

Demands

  • Repay the total amount of CAD $10,000, plus contractual interest, within a firm deadline of ten (10) business days from receipt of this letter.
  • Provide my office with proof of full repayment of the loan within the same time limit.

Failure to comply with these demands within the time limit set will result in proceedings before the competent courts to obtain judicial recovery, together with a claim for the additional costs and interest incurred.

Yours truly,

Mtre Sophie Lemoine
